Wyman v. Newhouse
United States Court of Appeals for the Second Circuit
93 F.2d 313 (2d Cir. 1937)
Wyman (plaintiff) lured Newhouse (defendant) to fly from New York to Miami by falsely claiming she loved him and wanted to see him before leaving for Ireland; when he arrived, a deputy sheriff — accompanying Wyman — served him with a lawsuit summons while a photographer tried to capture the moment. Newhouse immediately flew back to New York and, on his lawyer's advice, ignored the summons; a Florida court entered a default judgment against him. When Wyman sought to enforce that judgment in New York, the district court dismissed the enforcement action.
