Estin v. Estin
United States Supreme Court
334 U.S. 541 (1948)
After Mrs. Estin (plaintiff) obtained a New York separation decree with $180 monthly permanent alimony in a proceeding where Mr. Estin (defendant) appeared, he later moved to Nevada and obtained an ex parte divorce there through only constructive service on Mrs. Estin, who never appeared in that Nevada proceeding, and the Nevada decree, despite being notified of the New York alimony award, made no provision for alimony; when Mr. Estin stopped paying alimony after the Nevada divorce, Mrs. Estin sued in New York for the arrears, and New York courts continued enforcing the original alimony award.
Whether the Full Faith and Credit Clause prevents a state that has awarded alimony to a separated wife from continuing to enforce that award when another state grants the husband an ex parte divorce.
