Kohama (petitioner) and his wife overstayed a nonimmigrant visitor visa, and their U.S. citizen daughter later filed immediate-relative visa petitions along with concurrent applications to adjust their status to permanent residents; the visas were approved, but the District Director denied the status adjustment because although the daughter and her husband submitted affidavits of support, they hadn't posted two $5,000 bonds guaranteeing the applicants wouldn't become dependent on the state. The son-in-law moved to reopen, detailing years of actually supporting his wife's parents and noting three additional employed siblings who could help if needed, but the District Director affirmed the denial.
Whether affidavits of support from immediate relatives are sufficient evidence to show that aliens will not become dependent on the state if granted permanent resident status.
