Nick Scampoli bought a television from Willie Wilson TV Appliances (Wilson), with a guarantee of ninety days' free service and one year of defective-part replacement. After delivery, the set would not turn on properly. Wilson's service representative could not identify the problem at the home and said he needed to take the chassis to his shop to inspect it. Scampoli's daughter refused to let him take the chassis and demanded a new set. Wilson refused to replace it, and Scampoli sued for the purchase price. The trial court ordered rescission and a refund. Wilson appealed, arguing he was denied the chance to repair.
Whether a seller of nonconforming goods may conform his tender by minor repairs.
