Taylor v. United States
Supreme Court of the United States
495 U.S. 575 (1990)
Arthur Lajuane Taylor (defendant) pleaded guilty to possessing a firearm as a convicted felon and faced a sentence enhancement under the Armed Career Criminal Act based on his prior convictions, including two Missouri second-degree burglary convictions. Taylor argued those burglary convictions should not count toward the enhancement because they did not involve conduct presenting a serious risk of physical injury to others. Under his plea agreement, Taylor retained the right to appeal the enhancement, and he did so.
Whether the term "burglary" in the Armed Career Criminal Act's sentence-enhancement provision is limited to the common-law definition of burglary or has some other uniform meaning.
