Abbott v. United States

In two consolidated cases, the defendants used a firearm while engaged in drug trafficking and received an additional five-year sentence under 18 U.S.C. section 924(c)(1)(A), on top of longer mandatory minimums under the Armed Career Criminal Act. The defendants argued the five-year enhancement should run concurrently with, rather than consecutively to, those other mandatory minimums.

Whether the additional five-year sentence imposed by 18 U.S.C. section 924(c)(1)(A) runs consecutively to a mandatory minimum sentence imposed under another statute such as the Armed Career Criminal Act.
