Corrections officer Gary DuBois let several inmates out of their cells to clean the cell block, and the inmates then jumped him, striking him and taking his keys and body alarm; Ronell Hanks (defendant) kicked DuBois and was told by others to watch for other officers. Roque was charged with, and convicted of, conspiracy, while the other defendants were convicted as accessories to first-degree assault and attempted escape. All defendants appealed, arguing insufficient evidence of a coordinated plan.
Whether, to be found guilty of conspiracy, the prosecution must prove that two or more defendants engaged in a mutual plan to commit a crime and that, following the agreement, one of them performed an act in furtherance of it.
