Eighteen-year-old Brady (defendant), diagnosed with an irreversible organic personality disorder from a childhood head injury, was found by an evaluator to lack the maturity and skills to currently parent her medically fragile newborn, though she visited daily and desired custody; CSD (plaintiff) placed the baby with a foster parent and, without providing Brady the recommended training or support, petitioned to permanently terminate her parental rights eight months later, even as Brady independently pursued counseling, parenting classes, her GED, and ended her volatile relationship with the baby's father. The trial court granted termination.
Whether it is appropriate to terminate a young, first-time mother's parental rights where she currently lacks parenting capacity but has shown a desire and ability to improve.
