K.A. and S.A. (defendants), parents of an infant and two older children, waited two weeks after the infant's most recent obvious injuries before seeking medical care; trial evidence showed the infant had been physically abused on numerous occasions, with one parent abusing the child while the other took no preventive action, though the older children were shown to be well treated. Florida's child welfare department (plaintiff) petitioned to terminate the couple's rights to all three children; the children's guardian ad litem opposed terminating rights to any child, but the judge terminated parental rights to all three, and the couple appealed.
Whether parental rights to more than one child may be terminated without individualized proof, as to each child, that the parents abused, neglected, or abandoned that specific child and that termination is the least restrictive option serving that child's best interests.
