Shapira v. Union National Bank
Ohio Court of Common Pleas for Mahoning County
315 N.E.2d 825 (1974)
David Shapira's will conditioned his son Daniel's (plaintiff) inheritance on Daniel being married to a Jewish woman with Jewish parents at the time of David's death, or, failing that, holding the inheritance in trust for up to seven years pending such a marriage, with the share reverting to the State of Israel if Daniel never married within that faith requirement in time; Daniel sued, arguing the condition was unreasonable, contrary to public policy, and violated his Fourteenth Amendment right to marry.
Whether a restriction on a devise requiring the putative devisee to marry within a particular faith violates public policy or the right to marry under the Fourteenth Amendment.
