Clobberie's Case

The case involved several bequests structured differently: one to a woman payable with interest when she turned twenty-one or married, whichever came first, and she died before either event; another to a man payable when he turned twenty-one, who also died first; and a third to a man conditioned on his reaching twenty-one in order to receive the gift, who likewise died before that age. In each instance, the question was whether the unpaid gift passed to the deceased beneficiary's own estate.
Whether a gift which the beneficiary may not take possession of until reaching a designated age or upon occurrence of a future event may pass to the beneficiary's estate if the beneficiary dies before the time for taking possession.
