The United Nations (UN) asked the International Court of Justice (ICJ) for an advisory opinion on whether, when a UN agent is injured while performing duties relating to an individual state, the UN may bring an international claim against that state's government for damages to either the UN or the injured agent, and if so, how the UN's interest in bringing such a claim compares to the interested state's own competing interests, such as protecting its national or bringing the claim itself.
Whether, when an agent of the UN suffers injury through performance of duties regarding an individual State, the UN may bring an international claim against the State for damages caused to either the UN or to the victim.
