Willy Rengifo (plaintiff) sued his former employer under the Fair Labor Standards Act (FLSA) to recover unpaid overtime wages. The defendants sought discovery into Rengifo's immigration status, Social Security number, and authorization to work in the United States, arguing the information was relevant to Rengifo's credibility since he had allegedly represented himself as a legal resident when hired. Rengifo moved for a protective order to block that discovery.
Whether, under Federal Rule of Civil Procedure 26(c), an order may be issued to prevent certain matters from being inquired into to protect a party or person from annoyance, embarrassment, oppression, or undue burden or expense.
