Kerwin (plaintiff), an MMA promoter, sued Haydak and CFFC (defendants) for antitrust conspiracy to block competitors from the Philadelphia MMA market, and sought discovery of business agreements and market shares alongside far broader requests — CFFC's fighter roster and contracts, financial documents, advertising materials, sponsor and employee lists, event videos, and venue contracts. The defendants refused, moved for a protective order, and argued Kerwin sought this information for an unfair business advantage rather than legitimate litigation purposes.
Whether, under Federal Rule of Civil Procedure 26(c)(1)(G), a party may move for a protective order upon showing good cause that an adversary seeks trade secrets during discovery.
