Robert Faulkner (defendant), a seaman, broke into a ship's hold to steal rum. While trying to plug a hole he had bored in the rum cask, he lit a match, accidentally igniting the leaking rum and eventually destroying the ship. At trial, the judge instructed the jury that if Faulkner was committing theft when the fire started, he should also be found guilty of the separate felony of setting the ship on fire, and the jury convicted him of both.
