Nollenberger v. United Air Lines, Inc.
United States District Court for the Southern District of California
216 F.Supp. 734 (S.D. Cal. 1963)
In a wrongful-death suit against United Air Lines (defendant), the jury returned a general verdict for Nollenberger (plaintiff) of $114,655, but its answers to special interrogatories on life expectancy, lost income, and taxes, while internally consistent with each other, did not match that general verdict figure. Nollenberger asked the court to either submit additional interrogatories to the jury, recalculate the verdict based on the existing interrogatory answers, or grant a new trial.
Whether a court may submit additional special interrogatories to a jury after the jury has already rendered its general verdict and answers to the original special interrogatories.
