Jones v. LA Fitness International, LLC

Khalif Jones (plaintiff) dislocated his elbow after striking the back wall of an LA Fitness (defendant) basketball court and sued, alleging the club negligently failed to make the court safe or warn of insufficient wall padding. LA Fitness moved for summary judgment and to exclude Jones's expert, sports and recreation consultant Steve Bernheim, who opined the court failed to meet national safety standards for clearance and padding; LA Fitness argued Bernheim wasn't qualified because he lacked medical or biomechanical expertise.
