The Amalgamated Clothing Workers sought certification as bargaining representative of Excelsior Underwear's employees. Before the secret-ballot election, Excelsior mailed employees a letter opposing unionization and outlining the negative consequences it foresaw. Amalgamated asked Excelsior for a list of employee names and addresses so it could respond, and Excelsior refused. The election resulted in only 35 of 246 employees voting for unionization, and Amalgamated challenged the result, arguing Excelsior's refusal had prevented it from communicating with employees before the vote.
Whether an employer must furnish a labor union seeking certification with a list of eligible employees' names and addresses so the union can present its views before a unionization election.
