Detling v. Edelbrock

Tenants (plaintiffs) sued their landlord (defendant) alleging numerous municipal housing-code violations breached an implied warranty of habitability, a theory Missouri courts had not previously recognized; the circuit court dismissed their claim for failure to state a cause of action, and the landlord separately argued on appeal that a statutory Housing Act remedy was the tenants' exclusive avenue for relief, a defense not raised in his answer below.
