Wilson (defendant) was drinking with Pierce and accused him of stealing his watch, which Pierce denied. After more accusations, Pierce claimed to be a burglar, and the two planned to break into a drugstore. That night, Wilson boosted Pierce through a window and, as soon as Pierce was inside, ran to a phone and called the police so Pierce would be arrested, as payback for the alleged theft. Pierce was arrested, but Wilson was charged and convicted of aiding and abetting the burglary. Wilson appealed, arguing the jury instruction was improper because it did not require that he have felonious intent.
Whether a person who participates in a felony as a feigned accomplice in order to entrap another is criminally liable for the felony.
