Watson v. Regional Transportation District

Jayma, an unlicensed passenger on a motorcycle jointly owned with her driver-husband Randy, was seriously injured when the motorcycle collided with an RTD (defendant) bus; the jury found RTD 51 percent and Randy 49 percent at fault, but the trial court, instructed to impute Randy's negligence to Jayma as co-owner, reduced her damages award by that 49 percent share. The court of appeals affirmed the imputation, and Jayma sought further review.
