Cindy and Kevin Vollet (plaintiff and defendant) reached an amicable divorce settlement including a joint-custody agreement with a non-cohabitation/overnight-guest-restriction provision both signed. The trial judge rejected that provision outright, reasoning that divorced parties should not have that kind of control over each other's lives, without hearing evidence on whether the provision served the children's best interests.
