Vohs v. Donovan

The Donovans (defendants) agreed to buy the Vohses' (plaintiffs') home, contingent on the plaintiffs first obtaining a home of their choice by a specific date; the plaintiffs timely secured such a home and communicated that to the Donovans, but the Donovans then failed to purchase the plaintiffs' home. The Donovans argued the contingency made the contract indefinite and illusory, and the trial court granted them summary judgment on that basis.
