Juan Carlos Zuniga (defendant), prosecuted for bank robbery, was seen by companions Andres Portal and Damaso Olivera entering a bank alone and leaving ten minutes later before the three drove off together; Portal and Olivera denied any knowledge of a robbery, while other evidence linked Zuniga to the crime and Zuniga claimed Portal was the actual robber, with his wife testifying he was home at the time. The judge denied Zuniga's request for a jury instruction requiring acquittal unless the jury found beyond a reasonable doubt that his alibi was false, and the jury convicted him.
