United States v. Robertson
United States Court of Military Appeals
37 M.J. 432 (1993)
Robertson's (defendant's) son Brad, overweight but secretly anorexic and bulimic, visited him during a school break and continued losing weight while in Robertson's care; a doctor examined Brad, thought he looked healthy, but recommended a follow-up checkup within the month that never occurred because Brad showed no visible signs of his hidden eating disorder while with Robertson. Brad died of cardiac failure from starvation his first night back with his mother, and Robertson was convicted of involuntary manslaughter; he appealed, arguing the evidence was insufficient.
Whether an individual can be found guilty of involuntary manslaughter when the deceased actively hid a deteriorating condition from him.
