United States v. Moore (2010)

United States Court of Appeals for the District of Columbia Circuit

612 F.3d 698 (2010)

Relevant factsFree

The Postal Service intercepted a cocaine-filled package addressed to a suspected fake name and had an undercover inspector, posing as a mail carrier, deliver it; Marlin Moore (defendant) signed for it using yet another false name, 'Kevin Jones,' and told the inspector the addressee was his girlfriend. After Moore left with the package he was arrested and charged with, among other things, making a false statement under 18 U.S.C. Section 1001. He was convicted and appealed, arguing his false signature was immaterial because the inspector neither knew nor asked for his actual name when accepting the signature.

IssueFree

Whether a statement is material under 18 U.S.C. Section 1001 if it has the tendency to influence, or is capable of influencing, a decision or other function of the government agency to which it was addressed.
