A jury convicted Antonio Crawford (defendant) of two counts of distributing heroin and crack cocaine, and the district court, after reviewing his lengthy history of drug dealing in his community along with his criminal record and associations, sentenced him to 210 months -- the bottom of the applicable 210-to-262-month Sentencing Guidelines range. Crawford appealed, and the case was held pending the Supreme Court's decision in Rita v. United States, which held that appellate courts may presume within-Guidelines sentences are reasonable.
Whether an appellate court may presume that a sentence is reasonable when the district court's sentence falls within the applicable Sentencing Guidelines range.
