The Trasks (plaintiffs) sued Olin (defendant) for design defect and negligence after a Winchester Model 94 rifle's hammer, in half-cocked position, struck an object and accidentally discharged, injuring Trask and his daughter; the plaintiffs sought discovery of all accidental-discharge incidents involving the Model 94 regardless of hammer position, which the district court initially granted over Olin's objection, and Olin moved for reconsideration arguing the request should be limited to half-cocked-position incidents.
Whether, under Federal Rule of Civil Procedure 26(b)(1), a party may obtain discovery regarding any non-privileged matter relevant to a claim or defense so long as the benefit of production outweighs the burden or expense.
