Canadian Hallatt (defendant) repeatedly bought large quantities of Trader Joe's (plaintiff) products in the U.S. and resold them at a markup in Canada through a store called "Pirate Joe's" using a similar logo and design, evading Trader Joe's refusal to sell to him through disguises and proxies; Trader Joe's sued for Lanham Act trademark infringement and unfair competition, and the district court dismissed for lack of subject-matter jurisdiction.
Whether the Lanham Act may be applied extraterritorially where the challenged conduct affects American foreign commerce, causes a cognizable Lanham Act injury, and such application is appropriate considering international comity.
