Toys "R" Us (plaintiff), through its acquired Imaginarium brand, sued Spanish companies Step Two (defendants) for trademark infringement over their similarly named and styled Imaginarium toy stores; Step Two had no U.S. stores, offices, employees, or advertising and its Spanish-language websites accepted only Spanish shipping addresses and currency, though its president visited U.S. trade shows annually and it purchased merchandise from U.S. sellers, and a Toys employee was nonetheless able to purchase from the site by shipping to a contact in Spain. The district court denied Toys's request for jurisdictional discovery.
Whether a federal court may exercise personal jurisdiction over a foreign company based solely on an interactive commercial website.
