Thompson v. Altheimer & Gray
United States Court of Appeals for the Seventh Circuit
248 F.3d 621 (7th Cir. 2003)
Thompson (plaintiff) sued her employer, Altheimer & Gray (defendant), for Title VII racial discrimination; during voir dire, juror Leiter said that as a business owner she would tend to favor the defendant and that her experiences with employees suing merely over failing to get a promotion or raise might "cloud" her judgment, though she said she'd try to be fair. After exhausting her peremptory challenges, Thompson's attorney asked the court to strike Leiter for cause, which the court refused, and the jury (including Leiter) found for Altheimer & Gray; Thompson appealed.
Whether a trial judge may strike a juror who suggests that she may not be able to decide a case fairly.
