Tantimonico v. Allendale Mutual Insurance Co.

Adult trespassers Tantimonico and McPhillips (plaintiffs), riding motorcycles on Allendale's (defendant) property, collided head-on with each other and were seriously injured; they sued for negligence, arguing Rhode Island's abolition of common-law duty-of-care distinctions between trespassers, licensees, and invitees entitled them to a reasonable duty of care even as trespassers, but the trial court granted Allendale summary judgment.
