T.F. v. B.L.
Supreme Judicial Court of Massachusetts
442 Mass. 522, 813 N.E.2d 1244 (2004)
T.F. and B.L. (plaintiff and defendant), an unmarried couple, jointly decided to have a child through artificial insemination using shared funds, but B.L. moved out shortly before the birth, initially promising continued financial support before later informing T.F. she wanted no further contact with either her or the child; the trial judge found no written or explicit oral agreement to co-parent but concluded B.L.'s conduct throughout the pregnancy created a binding implied contract that she breached by refusing support, though the judge declined to order support and instead reported the matter to the appeals court.
Whether an implied contract to co-parent a child with another person is binding when one party later changes her mind.
