Sunkidd Venture, Inc. v. Snyder-Entel
Court of Appeals of Washington
941 P.2d 16 (Wash. Ct. App. 1997)
William Entel signed a one-year lease extension on the apartment he shared with his wife, Shannon Snyder-Entel (defendant), who never signed either the original lease or the extension; when the couple later notified the landlord they intended to vacate early, the management company billed William for the remaining rent, which went unpaid and was eventually assigned to Sunkidd Venture (Sunkidd) (plaintiff). Sunkidd sued Shannon individually years later, after she and William had divorced, and the lower courts dismissed the claim on the basis that Shannon never personally signed the lease; Sunkidd appealed.
Whether debt incurred during a marriage for family expenses benefiting the family can be enforced against a spouse's separate property, even if the other spouse alone incurred the debt.
