Maurice Stockberger, an insulin-dependent diabetic prone to hostile, agitated episodes of low blood sugar, worked at a federal prison whose coworkers were aware of his condition; when he insisted on driving himself home during an episode, a coworker who doubted his fitness to drive nonetheless did not stop him, offer a ride, or contact his supervisor or wife. Stockberger drove erratically and was killed in a collision. His wife (plaintiff) sued the United States under the Federal Tort Claims Act, arguing the federal prison breached a duty of care by letting him drive in that condition; the lower court granted summary judgment for the government, and she appealed.
Whether a property owner has a common law duty to rescue a person on the property, if no special relationship exists between them.
