On the day she joined Powerhouse Gym (defendant), Gina Stelluti (plaintiff) took her first spin class; when the instructor directed the class to stand while cycling, her bike's handlebars came loose, and she fell and was injured. She had signed a standard membership waiver releasing Powerhouse from liability for exercise-related injuries. Stelluti sued Powerhouse and its operator, Casapenn Enterprises. The trial court granted summary judgment for Powerhouse based on the waiver, the appellate division affirmed, and the New Jersey Supreme Court granted review.
Whether a health club's liability waiver, signed as part of a standard membership agreement, is enforceable against a member's ordinary negligence claim for an exercise-related injury.
