Skaggs (defendant) and an accomplice were confronted by a deputy sheriff while stealing a vehicle. During a struggle over the officer's gun, Skaggs stabbed the officer and threatened to cut his throat; the officer eventually lost control of the weapon, and Skaggs and his accomplice fled in the officer's patrol car with the gun. Skaggs was convicted of theft, assault, robbery, and unauthorized use of a vehicle. He appealed, arguing the evidence did not show he intended to permanently keep the gun rather than merely disarm the officer to escape.
