State v. Moore

Montana Supreme Court

885 P.2d 457 (1994)

Relevant factsFree

Brad Brisbin disappeared and his body was never found; Larry Moore (defendant) was tried for his murder based partly on suspicious circumstances and conflicting statements Moore made about Brisbin's whereabouts. RFLP and PCR DNA testing on blood, muscle, and brain tissue found in Moore's truck could not exclude the samples as coming from Brisbin's biological relatives. The trial court admitted the DNA test results but excluded testimony about statistical population-frequency calculations based on that DNA. Moore was convicted and appealed.

IssueFree

Whether analysis of DNA samples is admissible evidence in a criminal trial.
