Alvin McCoy (defendant) was walking when a friend drove by in a car McCoy knew was stolen; the friend invited him over, and McCoy was about to get in when a police officer tried to arrest him just as he touched the car. McCoy fled but was caught. He pleaded guilty to receiving a stolen vehicle, testifying he intended to ride around in the car and knew it was stolen, but later moved to withdraw the plea before sentencing. The trial court denied the motion, but the court of appeals reversed, and the State (plaintiff) appealed.
