Jones (defendant), a police officer, pulled over a motorist for driving without a taillight; the motorist ended up in his cruiser under disputed circumstances and claimed Jones sexually assaulted her there, then sped off with no lights on after she got out, prompting her to chase the cruiser to get its tag number. The prosecution sought to introduce testimony from Trooper Byrd, who heard two truckers on a CB radio describing a state trooper speeding with no lights and a small car trying to catch up. The trial court admitted this as a present sense impression, and the Maryland Court of Special Appeals reversed, prompting the Court of Appeals of Maryland to grant certiorari.
