Rodney Holm (defendant), a member of a fundamentalist church, was legally married to Suzie Stubbs, then entered two additional religious-only marriages with Wendy Holm and with Suzie's 16-year-old sister, Ruth Stubbs, who conceived two children with him before turning 18. The state charged Holm with bigamy and unlawful sexual conduct with a minor; he was convicted and appealed, arguing his additional marriages were purely religious and that the bigamy law was unconstitutional under both the state and federal constitutions.
Whether a man who is legally married, but motivated by religious belief to enter two additional marriages solemnized only in religious ceremonies, has engaged in constitutionally protected conduct.
