Virgil Helmenstein (defendant) and several friends discussed and carried out a burglary of a store, and afterward agreed on a cover story in case they were caught. At trial, several members of the group testified against Helmenstein, and the only other witness, the store owner, confirmed a burglary occurred and described the missing merchandise but could not connect Helmenstein to it. Helmenstein was convicted, and he appealed the denial of his motion for a new trial.
