Kenneth Hardison and Jerry Jackson (defendants), along with two others, were tried together for robbing both the Lincoln Cafe and the Edison Motor Lodge. At the Lincoln Cafe, neither wielded a weapon, but at the Edison Motor Lodge, Hardison brandished a gun and Jackson assaulted the manager with brass knuckles. A jury acquitted the defendants of the Lincoln Cafe robbery but convicted them of the Edison Motor Lodge robbery and of conspiracy to commit robbery, and the trial court imposed separate, consecutive sentences for the conspiracy and robbery.
