State v. Davis
Missouri Supreme Court
6 S.W.2d 609 (1928)
Relevant factsFree
Davis (defendant) and Alberdina Lourie planned to have her husband, Edmon, killed for insurance money, and Davis tried to hire a supposed ex-convict, actually an undercover police officer, Dill, giving him photographs of Edmon and paying him $600 to carry out the murder. Dill never intended to go through with the killing and revealed his true identity when he arrived at the Lourie home, at which point Davis was arrested. Davis was convicted of attempted first-degree murder and appealed.
IssueFree
Whether mere solicitation of another to commit a crime, without an overt act moving directly toward the crime's actual commission, is sufficient to constitute criminal attempt.
