State v. Cassidy
Appellate Court of Connecticut
489 A.2d 386 (Conn. App. 1985)
Cassidy (defendant) ran into a former lover (the victim) at a bar, and the two went to his home, where she undressed and got into bed; from there, their accounts diverge, with the victim testifying Cassidy became violent and raped her, while Cassidy testified she instead became hysterical and began talking about her husband, who had died in Vietnam. At trial, Cassidy sought to introduce evidence that the victim had, on another occasion, had a sexual encounter with a different man during which she similarly became "crazy" and talked about her deceased husband; the trial court excluded this evidence, and Cassidy appealed.
Whether evidence of a sexual-assault victim's prior sexual history with a man other than the accused is admissible.
