Travis (defendant) signed a notarized paternity affidavit acknowledging fatherhood two days after the child's birth, but nearly three years later, when the Department of Revenue (plaintiff) sought a child-support order on the mother's behalf, Travis requested DNA testing simply to confirm paternity before being ordered to pay support, without alleging fraud, duress, mistake, or newly discovered evidence; the trial court ordered the testing over DOR's objection and denied DOR's motion to vacate.
Whether a party to a child-support proceeding is entitled to an order requiring genetic testing absent placing paternity in controversy through one of the statutory mechanisms and showing good cause.
