Soldano v. O'Daniels

After Villanueva threatened Darrell Soldano at Happy Jack's Saloon, Darrell's son Dustin ran to the neighboring Circle Inn (defendant) and asked an employee to call police or let him make the call himself, but the employee refused; Darrell was then shot and killed, and his estate (plaintiff) sued the Circle Inn for negligence, with the trial court dismissing the case on the theory the Inn had no duty to help since it didn't create the peril.
