Eagle Cab assigned its five-year radio-tower license agreement with Shoreline Communications (plaintiff) to Norwich Taxi (defendant), whose service area was wider and farther from the tower, without Norwich ever inspecting the tower beforehand; Norwich later found it couldn't install its own equipment on the tower or make profitable use of the space, declared the contract terminated, and stopped paying license fees. Shoreline sued for the unpaid fees, and the trial court found Norwich had made an uninspected unilateral mistake and assumed that risk by failing to inspect before the assignment, ruling for Shoreline; Norwich appealed.
Whether an assignee has greater rights or immunities than the assignor would have if there were no assignment.
