Robert Sarvis (plaintiff), convicted of bank fraud and having served over three years in prison, applied for teaching positions at Vermont State Colleges (College) (defendant), submitting a resume falsely claiming continuous work as a company president and chairman during his imprisonment and asking the College not to contact his former employers for references. After hiring Sarvis under three employment agreements, the College learned the truth from his probation officer and terminated him; Sarvis sued for breach of the employment agreements, and the trial court granted the College summary judgment.
Whether a party induced into a contract by fraud or misrepresentation can rescind the contract and avoid liability for any breach.
