Samuel Friedland Family Enterprises v. Amoroso
Supreme Court of Florida
630 So. 2d 1067 (1994)
Paula Amoroso (plaintiff) was injured when a rented sailboat broke apart; the sailboat was rented from a stand operated by Sunrise Water Sports on property leased from the Diplomat Hotel (defendant), which advertised the sailing rentals in its in-room brochures and let guests pay for rentals through their hotel room charges, using their room keys as collateral. Amoroso sued the Diplomat under a strict-liability theory, the trial court directed a verdict for the hotel, and the court of appeal certified to the Florida Supreme Court whether strict liability for defective products extends to commercial lease transactions.
Whether the doctrine of strict liability for defective products extends to commercial lease transactions of those products.
